Terms and Conditions

Section I: Conditions of Sale

To purchase any of my artworks displayed on this website www.ezeeart.com, particularly available on the Acrylic Paintings and Oil Paintings pages will be subject to the following Conditions of Sale.

1. Availability

• All orders depend on the availability of the artwork.

2. Age and Payment Requirement

• You must be over 18 years old.
• You must have a valid payment method.

3. Placing Orders

• Notify me by email with details of the artwork you wish to buy.

4. Accuracy of Images

• I have made every reasonable effort to display accurate images of the artwork on my website. However, I cannot guarantee your monitor will show the true colours and details of the original artwork.
• I will provide additional information you may request about the artwork.

 5. Pricing and Delivery Costs

• Prices shown on my website do not include delivery/shipping fees.
• I will provide all information you may request, including the price of the artwork, delivery/shipping costs and payment information.

 6. Payments

• Full payment is required before I ship your order of the artwork.
• I accept secure payment methods like bank transfer, PayPal, etc. I will not accept payment by Western Union or NoChex.
• Prices are listed in British Pounds (GBP). Payment must be made in GBP.
• You are responsible for any fees your payment method charges, like processing or wire transfer fees.

7. Delivery and Shipping

• I will ship the artwork along with a Certificate of Authenticity within 14 working days of receiving full payment.
• Delivery usually takes 3-5 days in the UK and 10-14 days internationally.
• I am not responsible for shipping delays after handing over the artwork to the carrier.
• The artwork will be delivered to the address you provided on your order, but not to P.O. boxes.
• I am not liable if you instruct the carrier to leave the package unattended.
• An additional charge will be made for re-shipping if the package is returned to me for failure to receive it or failure to provide me with the correct delivery address.
• You pay extra redirection charges if you change the shipping address after once the artwork has been handed over to the delivery/shipping carrier.
• You will be responsible for the cost of any delivery/shipping duties, if applicable.
• You are responsible for properly disposing of packaging.

8. Damage or Loss

• Inspect the artwork on delivery and note any damage to the courier.
• Notify me promptly of damage/loss and provide photos if possible.
• For damage, return the artwork within 14 days of receiving it. I will refund your full payment plus return shipping costs within 14 days of receiving it back.
• For lost items, notify me within 14 days of expected delivery. I will refund your full payment within 14 days.
• A refund will be made to the original method you used to pay for the artwork.

9. Returns and Cancellations

• You may return or cancel orders within 14 days of receiving the artwork. Notify me in writing.
• Returned artwork must be in its original condition.
• You pay return shipping costs and any delivery/shipping duties.
• I will refund your full payment within 14 days of receiving returned items.
• A refund will be made to the original method you used to pay for the artwork.
• If you do not return items, I will arrange pickup and deduct my collection costs from refunds.
• I may deduct value, from the refund, if items are damaged due to your mishandling.

10. Ownership and Title

•  Title and ownership transfers to the buyer upon my receipt of full payment.

11. Copyright

•  As the artist, I retain copyright and reproduction rights to the artwork even after the sale.
• Buyers may not reproduce or sell copies of purchased artwork without my written consent.

12. Warranties

• I warrant all art is an authentic original work created solely by me.
• I have not sold the rights to the artwork to another party.

13. Governing Law

• These conditions are governed by the laws of England.
• Any disputes will be settled exclusively in English courts.

Tracking Artwork Placement

Keeping records of my artwork’s owners and locations is important to me. Though this is not a mandatory condition, I appreciate buyers’ efforts to provide the following information:

• If you exhibit, display or lend the artwork to a gallery, institution or public venue, please notify me with details of:
  • The venue and date(s)
  • Whether the placement is permanent or temporary
• If you resell the artwork, please inform me of:
  • The date of sale
  • The new owner’s contact information (if possible)
• When selling to a new owner, please request that they continue providing placement updates to me (if possible).

This provenance tracking allows me to preserve records of my art’s history. While optional, keeping me updated is greatly appreciated.

Section II: Terms and Conditions of Using This Website

Welcome to www.ezeeart.com (the “Site”). This Site is owned and operated by Suhail Mitoubsi (Owner). By using this Site, you agree to be bound by these Terms and Conditions of Use (the “Terms”) so please read them carefully.

Use of Content

The content on the Site, including but not limited to text, images, illustrations, audio clips and videos (the “Content”), is provided for your personal, non-commercial use only. You may download, print and store selected portions of the Content, provided you: (1) only use these copies for your own personal, non-commercial use; (2) do not copy or post the Content online without the Owner’s permission, and (3) maintain any copyright and other notices contained in the Content. Blog Posts and Comments

The statements and opinions expressed in blog posts on the Site are solely those of the original authors and other users. The Owner does not endorse nor is responsible for the accuracy or reliability of any opinion, advice or statement expressed within blog posts and comments. By accessing the blog, you acknowledge and accept that you may be exposed to content you find offensive or objectionable. You agree that you must evaluate and make your own judgment regarding blog posts and comments.

Purchases

All purchases made through the Site are governed by the Owner’s Conditions of Sale mentioned above in Section I. You must read and agree to the terms of the Conditions of Sale to make any purchases. 

Intellectual Property

All content included on this Site is the property of the Owner or used with permission from the copyright and/or trademark owner. Any use of the Site’s content without the written permission of the Owner is strictly prohibited.

Privacy Policy

Please read the Privacy Policy carefully. By using the Site and submitting information to us, you are accepting and agreeing to the collection, use and disclosure of your information as explained in the Privacy Policy. If you do not agree to the policy, then you should stop using the Site. The continued use of the Site signifies your acceptance of the Privacy Policy.

The Owner reserves the right to modify these Terms at any time. Updated versions of the Terms will be posted on the Site and are effective immediately upon posting. These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
